1. Acceptance of Terms

By downloading, installing, accessing, or using the ROADASSIST+ mobile application (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you must not use the App.

These Terms constitute a legally binding agreement between you and ROADASSIST+ ("we", "us", or "our"). By using the App, you confirm that you have read, understood, and accepted these Terms in full.

2. User Eligibility

You must meet the following criteria to use ROADASSIST+:

• You must be at least 18 years of age, or the legal age of majority in your jurisdiction.
• You must have the legal authority to enter into this agreement.
• You must not have previously been suspended or banned from using the ROADASSIST+ platform.
• If registering as a service provider, you must have the appropriate qualifications, licences, and legal authority to offer the services you list on the platform.

3. Account Responsibilities

When you create an account with ROADASSIST+, you are responsible for:

• Providing accurate, current, and complete information during registration and keeping it up to date.
• Maintaining the confidentiality of your login credentials (email and password).
• All activities that occur under your account, whether or not you authorised them.
• Notifying us immediately if you suspect any unauthorised use of your account by contacting us at gayatridhingra09@gmail.com.
• Keeping your phone number current if you are registered as a service provider, as clients contact you through this number.

4. Permitted and Prohibited Usage

Permitted Usage: You may use ROADASSIST+ to:

• Request legitimate roadside assistance services for your vehicle.
• Offer genuine roadside assistance services as a registered service provider.
• Browse the EV charging station map for navigation purposes.
• Link a genuine insurance policy for eligible claim assistance.
• Manage your vehicle records, profile, and service history.

Prohibited Usage: You must not use ROADASSIST+ to:

• Submit false, fraudulent, or malicious service requests.
• Impersonate another person, technician, or organisation.
• Harass, threaten, or abuse any other user of the platform.
• Attempt to access, manipulate, or reverse-engineer any part of the App's code, database, or API.
• Use the platform for any unlawful purpose or in violation of any applicable laws or regulations.
• Submit fake vehicle information, insurance details, or pricing data.
• Create multiple accounts for the purpose of abusing the system or circumventing a suspension.
• Use automated bots, scripts, or tools to interact with the App.

5. User-Generated Content

Users may submit content to ROADASSIST+ including profile bios, vehicle information, service descriptions, and completion notes. By submitting content, you:

• Confirm that the content is accurate and does not violate any applicable law.
• Grant ROADASSIST+ a non-exclusive, royalty-free licence to store and display the content as part of the platform's operation.
• Accept full responsibility for the content you submit.

We reserve the right to remove any content that violates these Terms or that we deem inappropriate, without prior notice.

6. Service Provider Conduct

Service providers registered on ROADASSIST+ agree to:

• Provide services honestly, professionally, and to the best of their ability.
• Only offer services they are qualified and legally authorised to perform.
• Set accurate and honest fixed prices for their listed services.
• Respond to service requests in a timely manner.
• Use the verification code system as designed — only confirming on-scene arrival and completion when they are genuinely present and the work is genuinely done.
• Not contact clients outside of the platform for purposes unrelated to the job.

Providers who violate these conduct standards may have their accounts suspended or permanently terminated.

7. Pricing and Payments

ROADASSIST+ operates on a transparent fixed-pricing model:

• Service providers set their own fixed prices (in Indian Rupees, ₹) for each service category they offer.
• Prices are displayed to the client before a service request is confirmed.
• ROADASSIST+ acts as a marketplace platform and does not process payments directly between clients and providers at this time.
• Payment arrangements for services are the responsibility of the client and the provider.
• Parts and consumable costs (such as fuel or replacement batteries) are separate from the service fee and are agreed upon directly between client and provider.

8. Intellectual Property

All content within ROADASSIST+ — including but not limited to the application name, logo, design, interface, source code, and written content — is the exclusive property of ROADASSIST+ and is protected by applicable intellectual property laws.

You may not copy, reproduce, redistribute, modify, or create derivative works from any part of the App without our prior written consent. Unauthorised use of our intellectual property may result in legal action.

9. Third-Party Services

ROADASSIST+ integrates with third-party platforms to deliver its features, including Supabase, OpenStreetMap, and insurance verification partners. By using the App, you acknowledge that:

• Third-party services have their own terms of service and privacy policies.
• ROADASSIST+ is not responsible for the availability, accuracy, or conduct of third-party services.
• Use of the EV charging map is dependent on OpenStreetMap data, which may not always be complete or current.
• Insurance verification is subject to your insurer's own terms and the data they provide.

10. Service Availability

ROADASSIST+ is provided on an "as available" basis. We do not guarantee:

• Continuous, uninterrupted, or error-free operation of the App.
• The availability of a technician at any given time in your specific location.
• That response times will always meet the stated 30-minute SLA, particularly during high-demand periods or adverse weather conditions.
• The accuracy of real-time mapping or GPS data, which is dependent on device hardware and external services.

We reserve the right to suspend, modify, or discontinue any feature or the entire service at any time without prior notice, though we will make reasonable efforts to inform users of significant changes.

11. Limitation of Liability

To the fullest extent permitted by applicable law:

• ROADASSIST+ is a platform that connects clients with independent service providers. We are not the service provider and are not responsible for the quality, safety, or outcome of any roadside assistance performed.
• We are not liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the App.
• We are not liable for any losses resulting from your inability to access the App, including during emergencies.
• We are not responsible for any damage to your vehicle during or after a service performed by a provider discovered through our platform.

12. Account Suspension and Termination

We reserve the right to suspend or permanently terminate your account if:

• You violate any of these Terms and Conditions.
• You engage in fraudulent, deceptive, or abusive behaviour on the platform.
• You harass, threaten, or harm any other user.
• We are required to do so by law or a court order.

You may also choose to terminate your account at any time by deleting it via your User Profile or by submitting a request through our Account Deletion page. Upon termination, your right to use the App ceases immediately.

13. Privacy

Your use of ROADASSIST+ is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the data practices described in the Privacy Policy. Please review it carefully to understand how we collect, use, and protect your personal information.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. We will update the effective date at the top of this page when changes are made. If the changes are significant, we will make reasonable efforts to notify users through the app or via email. Your continued use of the App after any change constitutes your acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these Terms or your use of ROADASSIST+ shall be subject to the exclusive jurisdiction of the courts of Delhi, India.
